1. Acceptance of Terms
By downloading, installing, or using the MediCue mobile application, you accept and agree to be bound by these Terms of Use. MediCue is a medication reminder application designed to help you manage your pill schedule. If you do not agree to these terms, please do not use our app.
2. Medical Disclaimer
IMPORTANT: MediCue is a reminder tool only and is not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions regarding medications or medical conditions. Never disregard professional medical advice or delay seeking it because of information from MediCue.
2.1 Not a Medical Device
MediCue is not a medical device and has not been evaluated by the FDA or other medical regulatory agencies. It is designed solely as a convenience tool to help remind you to take medications as prescribed by your healthcare provider.
2.2 User Responsibility
You are solely responsible for:
- Verifying medication information entered into the app
- Following your healthcare provider's instructions
- Reporting any adverse reactions to your doctor
- Ensuring medication safety and storage
3. Description of Service
MediCue provides a mobile application for iOS devices that offers medication reminder services. Our features include:
- Customizable medication schedules and reminders
- Pill tracking and adherence monitoring
- Medication history and reports
- Premium subscription features (weekly and yearly plans)
- Cloud synchronization across devices
3.1 Service Availability
We strive to maintain continuous service availability but cannot guarantee uninterrupted access. Medication reminders depend on your device settings, internet connectivity, and app permissions.
4. Subscription Services
MediCue offers premium features through subscription plans:
4.1 Subscription Plans
- Weekly Subscription: Access to premium features for one week
- Yearly Subscription: Access to premium features for one year
4.2 Billing and Payments
- Subscriptions are billed through your Apple App Store account
- Payment is charged upon confirmation of purchase
- Subscriptions automatically renew unless cancelled 24 hours before the current period ends
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
4.3 Free Trial
We may offer free trial periods for premium features. If you don't cancel before the trial ends, you will be charged for the subscription. Unused trial time is forfeited upon subscription purchase.
5. User Conduct and Data Accuracy
You agree to:
- Provide accurate medication information when setting up reminders
- Use the app in accordance with your healthcare provider's instructions
- Not share your account with others
- Not use the app for illegal substances or unauthorized medications
- Report any app malfunctions that could affect medication safety
6. Privacy and Health Information
Your health information is sensitive and important to us. Our Privacy Policy explains how we collect, use, and protect your medication data and personal health information. By using MediCue, you agree to our data practices as outlined in our Privacy Policy.
6.1 Health Data Sharing
MediCue may integrate with Apple Health (HealthKit) to sync medication data. You control what information is shared through your device's privacy settings.
7. Intellectual Property Rights
The MediCue app, including its design, functionality, content, and trademarks, is owned by MediCue and protected by copyright and trademark laws. You may not:
- Copy, modify, or distribute the app
- Reverse engineer or attempt to extract source code
- Use our trademarks without permission
- Create derivative works based on our app
8. Disclaimers and Limitations
MediCue is provided "AS IS" without warranties of any kind. We specifically disclaim:
- Warranties regarding medication reminder accuracy
- Responsibility for missed medications due to app malfunction
- Liability for medical decisions based on app data
- Guarantees of uninterrupted service
8.1 Limitation of Liability
In no event shall MediCue be liable for any health-related consequences, medical emergencies, or adverse outcomes related to medication management. Our liability is limited to the amount you paid for subscription services.
9. Device Requirements and Permissions
MediCue requires:
- iOS device with compatible operating system
- Notification permissions for reminders
- Internet connection for cloud features
- Camera permission for pill identification (optional)
- Health app integration permissions (optional)
10. Termination
You may stop using MediCue at any time by deleting the app. We may terminate your access if you violate these terms. Upon termination:
- Your access to premium features will cease
- Local data may be retained on your device
- Cloud data may be deleted according to our data retention policy
- Active subscriptions continue until their expiration unless cancelled
11. App Store Terms
Your use of MediCue is also subject to the Apple App Store Terms and Conditions. In case of conflict between these terms and App Store terms, Apple's terms prevail regarding app distribution and billing.
12. Updates and Changes
We may update MediCue to improve functionality, add features, or address security issues. Continued use after updates constitutes acceptance of changes. We will notify users of material changes to these terms through the app or email.
13. Governing Law
These Terms are governed by the laws of [Your Jurisdiction]. Disputes will be resolved through binding arbitration, except for matters that may be heard in small claims court.
