2. Information We Collect

A) Photos and images you provide

• Property Photos: Images of rooms, exteriors, or other spaces you explicitly select and submit to the App for AI transformation.
• Transformation Prompts: Text instructions or style selections you provide to guide the AI (e.g., "modern living room," "virtual staging," "bright and airy").
• Generated Results: The AI-transformed images produced from your submissions, which are returned to you and may be stored locally on your device.

B) Photo library access

The App requests access to your photo library only to allow you to select images for transformation. We do not scan, index, or upload your entire photo library. Only the specific photo(s) you choose to submit are processed.

C) Technical information (minimal)

We may process minimal technical data needed to operate the App and deliver transformation requests, such as app version, device language, and basic error information. We do not use this information for tracking or advertising.

3. How We Use Information

We use information only to provide and operate the App, including to:

• Transmit your selected photo(s) and transformation instructions to AI providers to generate transformed images
• Return and display the AI-generated results to you within the App
• Maintain reliability, prevent abuse, and debug failures
• Provide customer support if you contact us

We do not use your photos, prompts, or generated images for targeted advertising, data brokerage, or tracking.

4. Third-Party AI Processing

To provide AI photo transformation features, the App transmits your selected photos and transformation instructions off-device to third-party AI services. This is the core mechanism by which HostShot works.

A) Who we share with

• Replicate, Inc. — hosts and runs a variety of open-source and proprietary image generation and transformation models.
• Stability AI Ltd. — provides Stable Diffusion and related image synthesis models.
• OpenAI, L.L.C. — provides image generation and understanding models (e.g., DALL·E, GPT-4o Vision).
• Google LLC — provides image understanding and generation models (e.g., Gemini Vision, Imagen).

Not every transformation uses all four providers. The specific provider(s) used depend on the transformation style or feature you select within the App.

B) What data is sent

When you initiate a transformation, the App sends:

• The photo(s) you explicitly selected for transformation
• Your transformation prompt or style selection (e.g., "Scandinavian bedroom," "remove clutter," "add virtual furniture")
• Minimal technical metadata required to route and deliver the request (e.g., model identifier, image dimensions, app version)

C) When data is sent

• Only on explicit action: Data is sent to AI providers only when you tap the transform/generate button for a specific photo. No background uploads occur.
• No passive collection: The App does not send photos in the background, at launch, or without your direct action.

D) User controls

• You can revoke photo library access at any time in device Settings → Privacy & Security → Photos.
• You choose which photo to submit each time — no automatic or batch uploads occur without your action.
• You can delete generated results from within the App or from your device's photo library.

E) Data retention by third-party AI providers

We do not sell your photos or prompts, and we do not allow third parties to use them for advertising through our App. However, third-party AI providers may process and retain submitted data according to their own terms and policies for purposes such as safety, abuse prevention, and service reliability. We encourage you to review each provider's privacy policy:

5. What We Do Not Collect or Use

• We do not track your activity across other companies' apps and websites.
• We do not collect or share data for targeted advertising.
• We do not sell your photos, prompts, or generated images.
• We do not scan or upload your entire photo library — only photos you explicitly select.
• We do not collect location data, contacts, or any data unrelated to photo transformation.
• We do not use your photos to train our own AI models.

6. Sharing of Information

We share information only in these cases:

• With AI providers (Replicate, Stability AI, OpenAI, and/or Google) to fulfill your transformation requests as described above
• With service providers strictly for app operation (if applicable), under confidentiality obligations
• If required by law or to protect rights, safety, and security
• In a business transfer (e.g., merger/acquisition), with notice where required

7. Data Storage and Deletion

• The App may store your transformation history and settings on your device to provide continuity and user experience.
• You can delete your transformation history within the App and/or by deleting the App from your device.
• Generated images saved to your photo library will remain there until you delete them manually.

8. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information. No method of transmission or storage is 100% secure.

9. Children's Privacy

The App is not intended for children under 13 (or the minimum age required in your country). We do not knowingly collect personal information from children.

10. International Transfers

Your information may be processed in countries other than where you live, including where our service providers and AI providers operate. These locations may have different data protection laws.

11. Your Rights and Choices

Depending on your location, you may have rights to access, correct, delete, or object to certain processing of your information. You can contact us at kaanyildiz.iosdev@gmail.com.

You can also control photo library permissions in device settings and delete your transformation history within the App.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will update the "Effective Date" above and, when appropriate, provide additional notice in the App.

1. Acceptance of Terms

By accessing or using HostShot, you confirm that you are at least 13 years of age (or the minimum age required in your country), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the App.

2. Description of Service

HostShot is an AI-powered photo transformation application designed for real estate professionals, homeowners, and property sellers. The App allows you to:

• Submit photos of properties (rooms, exteriors, spaces) for AI-powered transformation
• Apply virtual staging, style changes, lighting enhancements, and other AI-generated modifications
• Download and use the resulting transformed images for real estate listings, marketing, and related purposes

The App uses third-party AI services including Replicate, Stability AI, OpenAI, and Google to generate transformation results. The quality and accuracy of results depend on these underlying AI models and may vary.

3. Acceptable Use

You agree to use HostShot only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit photos that contain illegal content, including content that violates privacy laws or infringes third-party intellectual property rights
• Use the App to generate deceptive, misleading, or fraudulent real estate listings or marketing materials
• Submit photos of people without their consent, or use the App to generate realistic depictions of real individuals without authorization
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or App source code
• Use automated scripts, bots, or other means to access the App in a manner that exceeds normal usage
• Resell, sublicense, or commercially redistribute the App or its outputs as a standalone AI service
• Use the App in any way that violates applicable laws or regulations in your jurisdiction

4. Content You Submit

A) Your responsibility

You are solely responsible for the photos and prompts you submit to the App. By submitting content, you represent and warrant that:

• You own or have the necessary rights and permissions to submit the content
• The content does not violate any applicable laws or third-party rights
• The content does not contain personally identifiable information of individuals who have not consented to its use

B) License to process

By submitting a photo for transformation, you grant us and our AI service providers a limited, non-exclusive license to process that photo solely for the purpose of generating your requested transformation result. This license does not extend to any other use.

C) Real estate disclosure obligations

AI-generated transformations are visual representations and may not reflect the actual current condition of a property. When using transformed images in real estate listings or marketing materials, you are solely responsible for ensuring compliance with all applicable real estate disclosure laws and regulations in your jurisdiction.

5. Ownership of Generated Images

Subject to these Terms and the terms of the underlying AI providers, you own the transformed images generated from your submitted photos. We do not claim ownership over your input photos or the resulting outputs.

However, the underlying AI models used to generate transformations are owned by their respective providers (Replicate, Stability AI, OpenAI, Google), and their terms may impose additional conditions on generated content. You are responsible for reviewing and complying with those terms.

6. Subscriptions and Payments

HostShot may offer subscription plans or in-app purchases that provide access to premium features, additional transformation credits, or higher-quality AI models.

• Billing: Subscriptions are billed through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You can manage and cancel subscriptions in your Apple ID account settings at any time. Cancellation takes effect at the end of the current billing period.
• Refunds: All purchases are subject to Apple's refund policy. We do not issue refunds directly — please contact Apple Support for refund requests.
• Price changes: We may change subscription prices. You will be notified in advance and your subscription will not renew at the new price without your consent.

7. AI-Generated Content Disclaimer

HostShot uses AI models to generate transformed images. You acknowledge and agree that:

• AI-generated results are not guaranteed to be accurate, realistic, or suitable for any particular purpose
• Results may vary significantly depending on the quality of the input photo, the selected style, and the underlying AI model
• Generated images are artistic interpretations and do not constitute professional architectural, interior design, or real estate advice
• We are not responsible for any decisions made based on AI-generated transformations

8. Third-Party Services

The App integrates with third-party AI services (Replicate, Stability AI, OpenAI, Google). Your use of these services through the App is also subject to their respective terms of service and policies. We are not responsible for the availability, accuracy, or conduct of these third-party services.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any particular transformation result will meet your expectations.

10. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App or any AI-generated content, even if we have been advised of the possibility of such damages.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, us, or third parties. You may stop using the App at any time by deleting it from your device.

12. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the competent courts.

13. Changes to These Terms

We may update these Terms from time to time. We will update the "Effective Date" above and, when appropriate, provide additional notice in the App. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
