2. Information We Collect

A) Information you provide

• Documents: PDF files and other documents you import, upload, or create within the App for the purpose of signing or sending.
• Signature data: Your drawn or typed signature as captured within the App when you sign a document.
• Form field inputs: Text, dates, initials, or other values you enter into document fields.
• Signer information: Names and email addresses you enter when preparing a document for others to sign.

B) AI-assisted features (only when you use them)

If you use AI-powered features (such as smart field detection or document summarization), the App may send relevant document content to OpenAI to generate results. This occurs only when you explicitly trigger an AI feature.

C) Technical information (minimal)

We may process minimal technical data needed to operate the App, such as app version, device language, and basic error information. We do not use this information for tracking or advertising.

3. How We Use Information

We use information only to provide and operate the App, including to:

• Enable you to sign, send, and manage documents
• Generate AI-assisted results you request (e.g., smart field detection, document analysis) when you trigger them
• Maintain reliability, prevent abuse, and debug failures
• Provide customer support if you contact us

We do not use your information for targeted advertising, data brokerage, or tracking.

4. Third-Party AI Processing (OpenAI)

To provide AI-powered features, the App may transmit certain document content off-device to OpenAI.

A) Who we share with

• OpenAI (OpenAI, L.L.C.) — the sole AI provider used by eSign.

B) What data is sent

Depending on which AI features you use, the App may send:

• Relevant portions of document text needed to perform the AI-assisted action (e.g., field detection, document summarization)
• The minimum necessary context to generate an accurate result
• Minimal technical metadata required to route and deliver the request (e.g., app version, device language)

C) When data is sent

• AI-assisted features: Only when you explicitly trigger an AI feature within the App (e.g., tapping "Detect Fields" or requesting a document summary).
• Document content is never sent to OpenAI passively or in the background.

D) User permission and controls

• AI features require explicit user action — they are never triggered automatically.
• You can choose not to use any AI features; all core signing functionality works without them.

E) Data retention by OpenAI

We do not sell your document data, and we do not allow OpenAI to use it for advertising through our App. However, OpenAI may process and retain request data according to their own terms and policies for purposes such as safety, abuse prevention, and service reliability.

5. What We Do Not Collect or Use

• We do not track your activity across other companies' apps and websites.
• We do not collect or share data for targeted advertising.
• We do not sell personal data or document content.
• We do not store your documents on our servers — documents remain on your device unless you explicitly share them.
• We do not intentionally collect sensitive personal data beyond what you choose to include in documents you process.

6. Sharing of Information

We share information only in these cases:

• With OpenAI to fulfill AI-assisted requests you explicitly trigger, as described above
• With recipients you designate when you send a document for signing (e.g., sharing a document link or file)
• With service providers strictly for app operation (if applicable), under confidentiality obligations
• If required by law or to protect rights, safety, and security
• In a business transfer (e.g., merger/acquisition), with notice where required

7. Data Storage and Deletion

• Documents, signatures, and settings are stored locally on your device.
• You can delete individual documents or all app data within the App at any time.
• Deleting the App from your device will remove all locally stored documents and data.
• Documents you have sent to others for signing may remain accessible to those recipients until they delete them.

8. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information. No method of transmission or storage is 100% secure.

9. Children's Privacy

The App is not intended for children under 13 (or the minimum age required in your country). We do not knowingly collect personal information from children.

10. International Transfers

Your information may be processed in countries other than where you live, including where our service providers and AI providers operate. These locations may have different data protection laws.

11. Your Rights and Choices

You can delete your documents and data directly within the App at any time, and you can choose not to use AI-assisted features entirely.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will update the "Effective Date" above and, when appropriate, provide additional notice in the App.

1. Acceptance of Terms

By accessing or using eSign, you confirm that you are at least 13 years old (or the minimum age required in your country) and that you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or business purposes on your Apple device, subject to these terms and Apple's App Store terms.

• You may not copy, modify, distribute, sell, or sublicense any part of the App.
• You may not reverse engineer, decompile, or attempt to extract the source code of the App.
• You may not use the App for any unlawful purpose or in violation of any applicable law or regulation.

3. Your Content and Documents

You retain full ownership of all documents, signatures, and data you create or import into the App. By using AI-assisted features, you grant us a limited right to transmit relevant document content to OpenAI solely to fulfill your request.

• You are solely responsible for the content of documents you sign or send.
• You must not use the App to sign, create, or send fraudulent, forged, or illegal documents.
• You represent that you have the authority to sign any document you execute through the App.

4. AI-Assisted Features

The App offers optional AI-powered features (such as smart field detection and document analysis) powered by OpenAI. By using these features:

• You acknowledge that relevant document content will be transmitted to OpenAI to generate results.
• You agree not to submit documents containing highly sensitive personal data (e.g., government IDs, financial account numbers) through AI features unless you accept the associated risk.
• AI-generated results are provided as-is and may not be perfectly accurate. You are responsible for reviewing all AI output before acting on it.

5. Subscriptions and Purchases

Certain features of the App may require a paid subscription or in-app purchase, processed through Apple's App Store. All purchases are subject to Apple's payment terms.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your Apple ID account settings.
• We do not offer refunds outside of Apple's standard refund policy.

6. Prohibited Uses

You agree not to use the App to:

• Forge, falsify, or fraudulently execute any document or signature.
• Violate any applicable law, regulation, or third-party rights.
• Attempt to gain unauthorized access to any system or data.
• Transmit malware, viruses, or any harmful code through the App.
• Impersonate any person or entity when signing or sending documents.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that AI-generated results will be accurate or complete.

8. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of business, or reliance on AI-generated output.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by deleting it from your device.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer operates, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.

11. Changes to These Terms

We may update these Terms of Use from time to time. We will update the "Effective Date" above and, where appropriate, provide notice within the App. Continued use of the App after changes constitutes acceptance of the updated terms.
